What Food Makers Need to Know
By registering as a Food Maker and listing or selling food products through My Local Crafters (the “Platform”), you acknowledge and agree to the following Terms & Conditions. These Terms apply to all food vendors regardless of location within the United States, and your continued participation on the Platform constitutes acceptance of these Terms.
You acknowledge that food laws vary by state, county, and municipality and may change over time. You agree that it is your sole responsibility, and not the responsibility of the Platform, to verify which licensing, inspection, labeling, food-handling, and business requirements apply to you in your location, and to ensure you meet all such requirements before listing or selling any food items through the Platform.
As a food vendor, you understand and agree that you are solely responsible for determining and maintaining compliance with all applicable federal, state, and local food laws, regulations, licensing requirements, labeling standards, and health and safety rules that apply to your business and your products. This includes, but is not limited to, cottage food laws, food establishment licensing, food handling certifications, health department requirements, zoning restrictions, labeling regulations, allergen disclosure laws, and any business registration or tax obligations. You confirm that you are legally permitted to produce and sell your food products in your jurisdiction and that you will maintain any required licenses, permits, certifications, and inspections as required by law.
You agree that all food products listed, sold, packaged, stored, handled, transported, or delivered through the Platform will be produced and managed in a safe, sanitary, and lawful manner. You further agree to clearly and accurately label your products in accordance with applicable law, including listing all ingredients, major allergens, net weight or volume, identity of your business, and any legally required disclaimers or notices. You are responsible for ensuring that all representations you make about your products — including ingredients, health claims, origin, safety, and compliance — are truthful and not misleading.
You understand that the Platform acts only as an online marketplace connecting buyers and independent vendors. The Platform does not create, prepare, package, store, inspect, test, endorse, or guarantee any food products sold by vendors and does not verify vendor compliance with food laws. You operate as an independent business and not as an employee, partner, agent, or representative of the Platform. All transactions, sales, deliveries, communications, and obligations relating to your products are solely between you and your customers.
You agree to indemnify, defend, and hold harmless the Platform and its owners, operators, employees, and affiliates from any claims, losses, damages, liabilities, costs, legal actions, or expenses arising out of or related to your products or business activities, including but not limited to illness, allergic reactions, contamination, labeling errors, regulatory violations, fraud, negligence, misrepresentation, or disputes with customers or authorities.
You further agree to conduct business professionally and responsibly, fulfill orders in a timely manner, communicate honestly with customers, and comply with applicable consumer protection laws. You acknowledge that the Platform reserves the right, at its sole discretion, to remove listings, suspend or terminate vendor access, or request proof of compliance at any time, particularly in the interest of safety or legal compliance. Vendor fees are generally non-refundable unless required by law.
By participating as a food vendor, you confirm that all information you provide — including legal identity, business details, product descriptions, pricing, and compliance documentation — is accurate and up-to-date. You agree to notify the Platform promptly if your legal authorization to sell food changes or if any issue arises that may affect consumer safety.
These Terms are governed by the laws of the state in which the Platform is operated, unless otherwise required by applicable law. The Platform may update these Terms from time to time, and continued use constitutes acceptance of any revisions. If you do not agree to these Terms, you must cease listing and selling food products through the Platform.
By registering as a food vendor, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
As a food vendor, you understand and agree that it is your sole responsibility to review, understand, and comply with all federal, state, and local laws and regulations that apply to the production, labeling, sale, handling, storage, transportation, and delivery of your food products. This includes confirming whether your products are legally permitted for sale under the food vendor or cottage food laws in your specific state and local jurisdiction. You agree to stay informed of any changes in applicable laws and to ensure ongoing compliance at all times.
