1.ACCEPTING THESE TERMS
This document and the other documents that we reference below are our “Terms of Use” (Terms) and guidelines that we require Crafters and Vendors to follow. These Terms are a legally binding contract between “you” (the Crafter) and “My Local Crafters LLC” (MYLC)
Please note that disputes with MYLC contains an arbitration clause and class action waiver – that you waive any right to have those disputes decided by a judge or jury, and that you waive your right to participate in class actions, class arbitrations, or representative actions.
By agreeing to the Terms, all disputes regarding payments, products or any other issues that arise directly between the Crafter (the seller) and Customer (the buyer) are between the seller and the buyer. My Local Crafters LLC will not be responsible for or involved in these issues. This contract sets out your rights and responsibilities when you use MyLocalCrafters.com. our mobile apps, and the other services provided by MyLocalCrafters.com (our “Services”), so please read it carefully. By using any of our Services you’re agreeing to the Terms. If you don’t agree with the Terms, you may not use our Services.
2. RULES FOR SELLERS, BUYERS AND VENDORS
Please read the specific rules that are relevant to you, depending on how you use the Services.
If you use any of our Services, you agree to these Terms, our Privacy policy and the Anti-discrimination policy.
Guidelines for Sellers. If you list any items for sale through our Services, these policies apply to you.
Guidelines for Buyers. If you use our Services to browse or shop, these policies apply to you. You can read them here.
Guidelines for Promoters. If you list your Craft Event on our site, these policies apply to you. Read this information.
3 PRIVACY POLICY
The privacy of your personal information is important to you, and just as important to us. Our Privacy Policy details how your information is collected, used and shared when you use our Services. By using our Services, you’re also agree that we can process your information in the ways set out in the Privacy Policy.
4. YOUR ACCOUNT WITH MYLC
You will be required to create an account with myLC to use our Services. Here are a few of the rules.
You must be 18 years of age to use our services.
Minors between the ages of 13 to 18 must be permitted to use our Services through an account owned by a parent or legal guardian with their appropriate permission and under their direct supervision If a child is under 13 years old, they are not permitted to use any services provided by myLC. You (the parent or legal guardian) are responsible for any and all account activity conducted by a minor on your account, and there may be products or services available that you will want to consider limiting a minor’s access to material online.
5. PROVIDE ACCURATE INFORMATION ABOUT YOURSELF
It is legally prohibited to use false information or impersonate another person or company through your account.
6. YOU ARE ACCOUNTABLE
You will be accountable for any activity on your account. If you’re registering as a business entity, you personally guarantee you have the authority to agree to the Terms on behalf of the business. Accounts are not transferable.
7. PROTECT YOUR PASSWORD
As we mentioned above, you’re solely responsible for any activity on your account, so it’s important to keep your account password secure.
8. OUR RELATIONSHIP
These Terms do not create any partnership, joint venture, employment, or franchisee relationship between you and myLC.
9. YOUR CONTENT
Content that you post using our Services is your content (so let’s refer to it as “Your Content”). We don’t make any claim to it, which includes anything you post using our Services (like shop names, profile pictures, listing photos, listing descriptions, reviews, comments, videos,
10. RESPONSIBILITY FOR YOUR CONTENT
You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to all parts of Your Content and that you’re not infringing or violating any third party’s rights by posting It.
11. PERMISSION TO USE YOUR CONTENT
By posting Your Content using our Services, you grant MYLC a license to use it. We are not making a claim to any ownership of your content, but we have your permission to use it to promote the website and your products. Example of permission to use your content to understand: When your Storefront or Shoppe is open and active you will have photos and descriptions for your buyers. We have permission to display it for the buyers, we can enhance or resize, so it looks best for the buyer on the website or app. When you post a photo of you or your latest product, we can feature it on our homepage to promote your business and MYLC.
12. INAPPROPRIATE CONTENT
To keep the integrity and morality of MYLC, you agree that the following will not be posted on this website. You will not post any content that is abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive. This includes wording that includes foul language/ curse words, sexual images or language, or political abusive language. You also agree not to post any content that is false and misleading or uses the Services in a manner that is fraudulent or deceptive.
13. REQUIREMENTS FOR YOUR STOREFRONT AND SHOPPE
HOMEMADE PRODUCTS ONLY
At this time, MYLC will only approve products that are handmade by you. Vintage items and craft supplies are not accepted products to sell in any Storefront or Shoppe.
14. BUSINESS REGISTRATION
In order for your application to be approved, MYLC will need to receive a copy of your State Registration Certificate as proof that you are registered business in your state.
15. YOUR USE OF OUR SERVICES
We grant you a license to use our services. This license is limited to our website. It is not exclusive, nor transferable, and can be cancelled at MYLC discretion. Including the following restrictions
16. OUR SERVICES WILL NOT BE USED TO BREAK THE LAW
You agree that you will not violate any laws using our Services. This includes any local, state, federal laws that may apply to you. For example, it’s your responsibility to obtain any permits or licenses that your Storefront or Shoppe requires, and to meet applicable legal requirements in your area. This includes the sales, sales tax and delivery of your items. You are not to engage in fraud (including false claims or infringement notices), theft, anti-competitive conduct, threatening conduct, or any other unlawful acts or crimes against MYLC.
17. PAY YOUR BILLS
You are responsible to pay your monthly fee for your business Storefront or Shoppe by the 1st of each month. It is also your responsibility for collecting and/or paying any applicable sales taxes for any purchases or sales you make through our Services.
18. DO NOT INTERFERE WITH OUR SYSTEM
You agree not to interfere with our system through harmful computer code or distributing viruses or any other means that will disrupt our services.
19. WE WANT YOUR SUGGESTIONS AND IDEAS
MYLC will never claim we know everything that is best for you, your business or our website – that’s where your ideas become very important to us. Any ideas or other materials you submit to MYLC are open to your fellow Crafters, Exhibitors and the public. Your ideas are used to improve your business, exhibitors and our Services. Your ideas that you offer come without compensation to you.
20. WE WILL COMMUNICATE WITH YOU
MYLC will communicate with you for updates or changes that may occur. Using our Services, you agree that we can send you information by email instead of mailing your paper copies.
21. DO YOU NEED TO LEAVE MYLC?
We understand that life changes and your relationship may have to end with MYLC. We would hate to see you go but you can close your Storefront or Shoppe at any time. You are required to use our services for a minimum of 3 months. from your account settings. Terminating your account will not affect the availability of some of Your Content that you posted through the Services prior to termination. And any outstanding bills will need to be paid.
22. WE CAN ASK YOU TO LEAVE
MYLC has the right to terminate your account and access to our services. If we determine that you, your content, your products or your use of our services violate our terms, we will suspend or terminate your account. All content and information associated with your account will no longer be available to you. MYLC is not liable to you for the effect that these changes may make including your income or your ability to generate revenue through our services.
YOU CAN’T SUE US FOR THESE THINGS
23. YOUR PURCHASE
MYLC does not have the ability to see products sold on this site except through images given by the Craters. Therefore, MYLC is not held accountable for their quality, safety, authenticity or their legality. Any legal claim that may occur is between the seller and the buyer. You, the buyer and the seller, release MYLC from any claims related to items sold through our Services. MYLC is not legally responsible for any items that cause physical injury, defective items or misrepresentation by the seller.
24. BE OUR SECOND SET OF EYES
MYLC has stated that in our Terms that we will not accept products that are offensive, inappropriate, that have a strong sexual, political or racist image or wording. If you come across materials such as this, please reach out to us at [email protected]. MYLC wants to be a place that is appropriate for all ages. MYLC is not responsible for the accuracy, copyright compliance, legality, or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.
25. MEETING NEW PEOPLE
Our Services are meant for you to meet new people online and in-person. We do ask you to be careful, and use good judgement when meeting new people, especially if it is a first-time meeting. We do not screen our Crafters except to see that they are in compliance with our Terms. We will not be held liable for any interactions between Crafters and Buyers nor Crafters and Exhibitors.
26. EXHIBITORS AND OTHER THIRD-PARTY ASSOCIATIONS
MYLC is a networking website where you will interact with Buyers, Exhibitors or contacts through Social Media pages. Accessing these relationships is out of our control and not our responsibility. Any agreements, terms or services are solely between you and the third party. If there should be a dispute, we encourage you to contact the other party and try to resolve the dispute amicably. You release MYLC from any claims, demands, and damages arising out of disputes with Buyers, Crafters, Exhibitors or Social Media relationships.
27. CHANGES TO THE TERMS
We may update Terms and Fees from time to time. We will contact you with any news that affects your business directly. It will be your decision to continue using our Services after each update. We will do the best we can to give you notice 30 days in advance. You are responsible for reviewing all updates. Your use of the Services following the changes constitutes your acceptance of the updated Terms/Fees.
